Pay My Bills Official Rules

1. How to Enter the Promotion:

a. These rules govern The Live 95.5 Pay My Bills Contest (the “Promotion”) being conducted by KBFF (the “Station”) beginning on Friday, March 22, 2013 at approximately 11:59pm Pacific Time (PT) and ending approximately on Friday, May 31, 2013 (End Date subject to change and determined by the Station) at 6:00pm PT.  

b. Entrants must visit the KBFF website at http://www.live955.com and click on the Promotion’s official entry page where they must complete and submit their entry with all the necessary required fields filled out.  Entry forms must include your first and last name, complete address, city, state, zip code, and telephone number, date of birth, valid email address and gender.  Entrants must also input the name of the bill and the bill amount (the total amount due) into their online entry form, and entrant must be the account holder on the bill being submitted.  

i. The amount that will be awarded to each contestant will be $200.00.  The maximum amount that will be paid is $200.00 even if the total amount due is more than $200.00.  Any bill that does not comply with these criteria will not be eligible and will be discarded.  

ii. All entrants who are LIVE VIP’s will also be qualified to win a $1,000.00 each week for the duration of the contest.  Winners will be randomly selected each Friday at approximately 4:30pm PT.

c. Only one internet entry per person and one internet entry per email address is permitted.  Internet entries will be deem made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address.  Multiple participants are not permitted to share the same email address.  All the entries submitted become the sole property of the Station and will not be acknowledged or returned.  Use of any device to automate entry is prohibited.  Proof of submission of an entry shall not be deeming proof of receipt by the Station.  The Station’s computer is the official time keeping device for the Promotion.  The Station is not responsible for entries not received due to difficulty accessing the internet, service outages or delays, computer difficulties and other technological problems.  All entries must be received by May 31, 2013 at approximately 4:00pm.

d. Throughout the Promotion Period (March 22, 2013 – May, 31, 2013) forty-five (45) contestants per week will be randomly selected from all eligible entries each week beginning on April 1, 2013 at 8:10am and ending at approximately 4:10pm on May 31, 2013 to participate in the Pay Your Bills on-air portion of the contest.  One randomly selected contestant name will be announced at the following times:  8:10am, 9:10am, 10:10am, 11:10am, 12:10pm, 1:10pm, 2:10pm, 3:10pm, 4:10pm PT each day Monday through Friday.  When the contestant hears his/her name at one of the approximate above times, the contestant will have nine (9) minutes to call 503-733-0955.  If the contestant successfully calls back within nine (9) minutes of their name being announced on-air, that contestant will win the prize (a $200.00 payable check), which will be awarded upon confirmation of eligibility and correct personal and bill information.  If the winner is deemed eligible at the time of winning when prompted to call and is at that time a LIVE VIP they will also be qualified for the grand prize drawing at the end of the week for a check payable to the winner for $1,000.00 US Dollars.  If the contestant whose name is announced on-air does not call back within the nine (9) minutes of his/her name being announced on-air, that contestant will forfeit their chance to win. In other words, if the contestant whose name is announced on air does not call back within the nine (9) minutes of his/her name being announced they will not be deemed the winner.  Once a contestant’s name is selected and called on the air at any of the times listed above, that contestant’s name is automatically removed from the database of eligible entries.  KBFF is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call. KBFF is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches. Due to delays in the KBFF online streaming of its broadcast signal, listeners to the online stream may not be able to participate in or may be disadvantaged in participating in on-air Promotions.

e. Once a contestant’s name is selected and called out on air at the times listed above, the contestant’s name is automatically removed from the database of eligible entries.  KBFF is not responsible for telephone service outages, delays, busy signals, equipment malfunction and any other technological difficulties that may prevent an individual from completing his/her telephone call.  KBFF is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.

f. Only one (1) internet entry per person and one (1) internet email address is permitted.

2. Eligibilities Restrictions:

a. The Promotion is open to all persons who are 18 years of age or older and who reside in the greater Portland Metropolitan/SW Washington area.  Persons who are Employees of the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the Portland metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

b. Listeners are eligible to win a prize in a contest conducted by the Station only once every once every thirty (30) days and only once every six (6) months if the prize is valued over $600. Only one (1) winner per 30 days is permitted in any Station promotion and may only win the specific contest outlined in these rules one time. You can only win a prize valued at $1.00 or more or event tickets valued at $1.00 or more (per ticket) from KBFF-FM once every thirty (30) days with the exception that all “Live 95.5 Pay My Bills” Contestants will be qualified to win a $1,000 each week throughout the duration of this promotion.

c. Winners will be required to sign a liability and publicity release and show a valid government- issued photo identification card and social security card to claim prize. Winners must also submit a copy of the bill with the account numbers blacked out or removed. This request may be after the winner is chosen.  Winner must provide the actual physical bill if KBFF-FM requests winner to do s.

d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements. The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3. Prizes:

a. A maximum of three-hundred and sixty (360) prizes will be awarded in the form of a two-hundred dollar ($200.00) check made out to the contestant winner.

b. A maximum of eight (8) grand prizes will be awarded to LIVE VIP’s in for form of a one-thousand dollar ($1,000.00) check will be made out to the contestant grand prize winners. 

c. Contestants will be awarded two-hundred dollars US ($200.00) in the form of a check payable to the participant regardless of the total bill amount that was submitted online at http://www.live955.com.  Prizes will be awarded upon confirmation of eligibility.

d. Prizes will be awarded in the form of a check issued by Alpha Broadcasting in the amount of two-hundred US dollars ($200.00) at the time of entry.  Checks will not be awarded, processed or mailed until the winner has claimed the prize at the Station (1211 SW 5th Ave., Floor 6, Portland, OR – 97204), presented all required documentation and signed all required release and tax forms.  The prize will not be mailed out.  The Station is not responsible for the safe arrival of a prize or prize certificate.  The Station is not responsible for any late penalties charged by the billing company.

e. All eligible winners will receive ONE (1) two-hundred ($200.00) US Dollars payable by Check with an estimated delivery to the station between 6-8 weeks.  All winners will be required to pick their check up at The Station.

i. All eligible LIVE VIP grand prize winners will receive one-thousand ($1,000.00) US Dollars payable by Check with an estimated delivery to the station between 6-8 weeks.  All winners will be required to pick up their check at The Station and sign the proper tax agreement forms provided by Alpha Broadcasting.

f. There is no substitution, transfer or cash equivalent for the prizes, except that a Sponsor may, solely at its own discretion, substitute prizes of comparable value or cash due to prize unavailability or where required by law.  The prizes are expressly limited to the items above and do not include taxes, gratuities or any other expenses.  Other restrictions may apply.

4. Selection of Winners:

a. Decisions of Station management with respect to the Promotion are final.

b. Up to three-hundred and sixty (360) winners will be selected in the manner described in Section 1of these Official Promotion Rules.

c. Up to eight (8) grand prize winners will be selected in the manner described in Section 1 of these Official Promotion rules.

d. Odds of winning depend, in part, on the number of eligible entries received.

e. Winners must listen to the Station to win, but do not need to be present to win.

f. Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form at the time they come to the Station to claim their winning or prize.  Failure to do so will result in prize forfeiture and an alternate winner will be chosen.

5. Conditions:

a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other Alpha Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.

b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.

d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Station will select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date.

e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion, “The Live 95.5 Pays My Bills Contest” promotion result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.

f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.

g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.

h. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by May 31, 2013 to “Pays My Bills Contest – Official Rules,” Attn: Promotions, KBFF, 1211 SW 5th Avenue, 6th Floor | Portland, OR 97204. For the names of the prize winners send a self-addressed stamped envelope for receipt by May 31, 2013 to the above address marked “Live 95.5 Pays My Bills Contest – Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and shall be posted online at http://www.live955.com.

i. The Station reserves the right to change the official contesting rules, contest period, prize amount awarded, number of prizes awarded, number of grand prizes awarded and any other Station promotion running in connection to this promotion during the contest period.

j. For those listening to the Station stream on the Internet:  please be advised that you may be listening to a delayed stream of the radio signal, which may vary depending on your computer’s memory capacity and your dial-up connection.  For that reason, we strongly recommend that you turn on your radio to the Station to participate in this or any other call-in contest to be sure that you are participating in “real time”.  The Station assumes no responsibility for contestants not making timely phone calls to the station as a result of the delays in the Internet stream.

k. Each Contestant agrees that:(i) any and all disputes, claims and causes of action arising out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Oregon District of [State] or the appropriate [State] State Court located in Multnomah County, OR; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion but in no event attorneys’ fees; and (iii) under no circumstances will a participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of Oregon [State], without regard to conflicts of law rules.

6. Privacy:

a.  By use of the Station’s website or by entering the Promotion through the Station’s website, you agree to the website’s Terms of Use Agreement located at http://radio.com/terms-of-use and to the use of your personal information as described in the Privacy Policy located at http://live955.com/privacy-policy.
